Bentley 250 Elite Policies

In consideration of the Agreement herein, LESSOR does lease or bareboat charter, to the undersigned (hereafer referred to as LESSE) the craft and equipment described herein. LESSEE agrees said craft will not be occupied by a greater number of persons than is shown in this rental agreement. In the event the craft is not returned at the time specified herein, said LESSE agrees to pay for OVERTIME AT THE POSTED RATE.

The LESSEE acknowledges he/she has carefully examined the craft and finds it suitable for the purpose for which it is leased and that other accessory equipment is in suitable and acceptable condition; that he/she will maintain both craß and equipment in a safe, dependable condition while in his/her custody.

LESSEE agrees not to use, nor permit the use:

Of the rental crat in a careles ful purges, to acry any unlawful substance, or while under the influence of liquor and or narcoties,

Of the rental craft in a careless or negligent manner,

By any other person not the signatory of this agreement or not equally qualified; or Of the rental craft to discharge any unlawful pollution or litter.

LESSEE acnowledges his her responsibility for the safe and proper operation of the craft and agrees to obey all applicable laws and regulations for him herself, passengers, and for the safety and welfare of other boaters and persons. It is AGREED AND UNDERSTOOD BY LESSEE THAT THE LESSOR shall not be held liable for damages, inconvenience, or loss caused by accident, breakdown, or malfunction of the rental craf. LESSEE FURTHER AGREES to indemnify and hold harmless the LESSOR from and against any/all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation, or possession of said rental craf. LESSEE further agrees to hold the LESSOR harmless should loss or damages occur to any of the LESSEE's personal property while carried in or on the rental craft including loss or damage caused by fire, water, theft, or any other cause whatsoever.

LESSEE expressly agrees to indemnify and hold LESSOR harmless of, from, and against any/all loss, costs, damages, attorney fee, and/or liability in connection with the enforcing of the foregoing rental contract by LESSOR, including expenses incurred in collection or attempting to collect delinquent rent and in the event of suit by LESSOR to recover possession of said rental property and/or to enforce any of the tenns, conditions, and/or provisions hercof. It is understood and agreed that venue of any action hereunder shall be in the country of LESSOR.

Upon return of the boat and equipment, an inspection will be made and any damages will be paid by LESSEE with a valid credit card. REMEMBER, YOU ARE RESPONSIBLE FOR ALL LOSSES AND DAMAGES caused by yourself, your passengers or otherwise. LESSEE is responsible for loss of income to LESSOR due to loss of service to vessel.
LESSEE agrees to indemnify owner for the full new replacement values of the craft and its equipment in the event it is confiscated by legal authorities.
NO REFUNDS will be made for poor weather or early returns.
The rules and regulations contained herein by the LESSOR are for the safety and welfare to all that use the facilities.

The LESSEE certifies that he/she has read and understands said rules and

regulations and further assumes the responsibility to see that his/her family and/or guest(s) will obey the rules.

NO OPEN FLAMES including, but not limited to, grills, fireworks, lanterns, etc. are allowed on rental boats.

This is to certify that I (we), the LESSEE (S) am/are capable in all aspects of the handling and operation of a craft such as the one rented.

ASSUMPTION AND ACKNOWLEDGMENT OF RISKS AND RELEASE OF LIABILITY AGREEMENT

In consideration of being allowed to participate in water sport events and activities and/or being provided with water sport recrcational property of services, for myself and any minor children for whom I am parent, legal guardian or otherwise responsible, and for my/our heirs, personal representatives or assigns:

ACKNOWLEDGMENT OF RISKS. Acknowledge that some, but not all, of the risks of participating in the water sport activity include: (1) Changing water flow, tides, currents, wave action and ships' wakes; (2) Collision with any of the following: other participants, the watercraft, other watercraft, and manmade or natural objects; (3) Wind shear, inclement weather, lightning variances and extremes of wind, weather, and temperature; (4) My sense of balance, physical coordination, ability to operate equipment, swim and/or follow directions; (5) Collision, capsizing, sinking or other hazard which results in wetness, injury, exposure to the elements, hypothermia, and/or drowning: (6) The presence of insects and marine life forms; (7) Equipment failure or operator error; (8) Heat or sun related injuries or illnesses, including sunbur, sunstroke, or dehydration; (9) Fatigue, chill and or dizziness which may diminish my/our reaction time and increase the risk of an accident.

EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY, Agree to assume responsibility for all the risks of the activity, whether identified above or nol, (EVEN THOSE RISKS ARISING OUT OF THE NEGLIGENCE OF THE RELEASEES NAMED BELOW). My/our participation in the activity is purely voluntary. I assume full responsibility for myself and any of my minor children for whom i am responsible, for any bodily injury, accident, illness, paralysis, death, loss of personal property and expenses thereof as a result of any accident which may occur while I/we participate in the activity (EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE RELEASEES NAMED BELOW). I agree to wear a U.S. Coast Guard approved personal flotation device (life jacket) while participating in the activity or riding in any watercraft.

RELEASE. I hereby release Paradise Cove Rentals LLC, Sportsmans Marina, its principals, directors, officers, agents, employees, and volunteers, their insurers and each and every landowner, municipal and/or governmental agency upon whose property an activity is conducted ("owner") and their insurers if any. (Collectively "Releases") FROM ANY AND ALL LIABILITY OF ANY NATURE FOR ANY AND ALL INJURY OF DAMAGE (INCLUDING DEATH) TO ME OR MY MINOR CHILDREN AND OTHER PERSONS as a result of my/our participation in the activity, EVEN IF CAUSED BY THE NEGLIGENCE OF ANY OF THE RELEASEES NAMED ABOVE, OR ANY OTHER PERSON (INCLUDING MYSELF).

I HAVE READ THIS ASSUMPTION AND ACKNOWLEDGMENT OF RISKS AND RELEASE OF LIABILITY AGREEMENT. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM WAIVING VALUABLE LEGAL RIGHTS, INCLUDING AND ALL RIGHTS I MAY HAVE AGAINST THE OWNER, THE OPERATOR NAMED ABOVE, OR THEIR EMPLOYEES, AGENTS, SERVANTS OR ASSIGNS.
